TRACKMYSHIPMENTS INC - TERMS AND CONDITIONS OF SERVICE

By using the TrackMyShipments service from TrackMyShipments Inc
(including, but not limited to, the TrackMyShipments website, email
system, shipment tracking, email alerts and SMS alerts), you agree
to be bound to the following Terms And Conditions:

GENERAL
> You must be 13 years of age or older to use the TrackMyShipments service.
> You must provide your email address and first and last names to sign up for the TrackMyShipments service.
> You must also provide a password for your account. The security of your account and password is entirely your responsibility. TrackMyShipments Inc cannot accept any liability for any loss or damage either directly or indirectly caused by any misuse of your account including, but not limited to, the use of your account caused by a failure to secure your logon details.
> These Terms And Conditions also cover additional features, which may be added from time to time.
> Your continued use of the service means that you consent to the current Terms And Conditions.
> TrackMyShipments Inc reserves the right to change these Terms And Conditions at any time without notice.
> The current Terms And Conditions can be viewed at any time at: www.trackmyshipments.com/conditions.html

CHARGES
> TrackMyShipments Inc reserves the right to charge for all or part of the TrackMyShipments service at a later date, but never without your prior consent. You will be given at least 2 weeks notice before the new charge(s) take effect and you can decide to discontinue the use of your account on the TrackMyShipments system at that time.

ADVERTISING
> All or a portion of the TrackMyShipments system is provided to you without charge and is supported by Advertising and/or Sponsorship.
> You are NOT allowed to block these advertisements at any time.

DISCLAIMER
It is VERY important that you understand that YOU AGREE TO THE FOLLOWING:

> TrackMyShipments Inc cannot accept any liability for any loss or damage caused by any misuse of your account including, but not limited to, the use of your account caused by a failure to secure your logon details.
> TrackMyShipments Inc is a service that provides information provided by 3rd parties to you in web, Internet, email and SMS text message formats. TrackMyShipments Inc makes no Intellectual Property ownership of this data provided by 3rd parties. TrackMyShipments Inc is NOT liable for this information, either directly or indirectly.
> TrackMyShipments Inc is NOT responsible if the information it provides to you is incorrect in any way.
> TrackMyShipments Inc is NOT responsible if the information or the format in which it is provided, or a breakdown of the service which causes you not to receive the information at all or in a timely manner, causes you any loss or damage either directly or indirectly.
> TrackMyShipments Inc is NOT responsible for any SMS Text charges to your cell/mobile phone bill - if you use the SMS Text portion of TrackMyShipments, you are liable for any costs incurred. > The use of all or any part of the TrackMyShipments service is at your own risk at all times. No warranties of any kind are given or should be implied.
> The TrackMyShipments service is supplied on an 'as-is' basis.

COPYRIGHT AND TRADEMARKS
> By using the TrackMyShipments system you acknowledge that the entire system is (c) 2008 TrackMyShipments Inc and you will not copy or aid the copying of any or all of the system for free or for payment.
> You may not exploit for profit any of the information provided to you by the TrackMyShipments system.
> The TrackMyShipments logo is a trademark of TrackMyShipments Inc. By using the TrackMyShipments system you agree not to copy or use TrackMyShipments Inc's trademarks without prior written permission.
> TrackMyShipments Inc is not affiliated to any of the companies that it receives information or data from, and in no way makes claims to their trademarks or copyrights.

YOUR INFORMATION
TrackMyShipments Inc will never provide your personal information (ie name, address, email address &/or phone number) that you supply to TrackMyShipments to a 3rd party. We may provide collected ('pooled') data to 3rd parties, but it will never include your personal information.

TERMINATION
> TrackMyShipments Inc reserves the right to close your TrackMyShipments account at any time without warning for cause.
> TrackMyShipments Inc reserves the right to close your TrackMyShipments account or the entire TrackMyShipments service without cause for business reasons, but with a reasonable warning which will never be less than 2 weeks.

FINALLY
> A failure by TrackMyShipments Inc to enforce part of the above does not mean a waiver of any other portion of the above.
> The above Terms And Conditions are the entire agreement between you and TrackMyShipments Inc.
